In response to the consultation on the "Not Proven" verdict, Victim Support Scotland (VSS) advocates for its abolition and replacement with a two-verdict system of "Guilty" and "Not Guilty." The current three-verdict system, which includes "Not Proven," is viewed by VSS as outdated and harmful, particularly to victims and their families. VSS argues that the not-proven verdict often leaves victims without a sense of justice and closure, contributing to ongoing trauma. Additionally, the organization highlights that the lack of a clear definition for the not-proven verdict causes confusion and perpetuates uncertainty within the criminal justice system. Therefore, VSS strongly supports moving to a simpler and more transparent two-verdict system to enhance fairness and clarity in Scottish criminal trials.
